This Product Disclaimer applies to jewellery displayed, advertised and sold by Bombay Jewellery and Cosmetics, under the brand name Bombay Jewellery, through https://bombayjewelleryhp.com.
Please review the relevant product description, specifications, measurements, care instructions, guarantee status and exchange eligibility before placing an order.
1. NATURE OF OUR PRODUCTS
Unless a product listing expressly states otherwise, our products are artificial, imitation, fashion or gold-plated jewellery.
They are not:
- Solid gold;
- Investment gold;
- Precious-metal bullion;
- Natural diamonds;
- Certified precious gemstones; or
- Financial or investment products.
Terms such as:
- Gold-plated;
- Gold finish;
- Golden;
- Matte gold;
- Antique gold;
- Silver finish;
- Diamond look;
- AD stone;
- Kundan;
- Pearl;
- Ruby colour;
- Traditional;
- Premium; or
- Royal
may describe a product’s appearance, finish, colour, design or decorative components.
Such terms do not represent that the product is made from solid gold, natural diamond, natural pearl, natural ruby or another precious material unless this is expressly and accurately stated in the individual product listing.
2. PRODUCT DESCRIPTIONS
We make reasonable efforts to provide accurate:
- Product names;
- Materials and finishes;
- Dimensions;
- Available sizes;
- Colours;
- Components;
- Quantity;
- Care instructions;
- Guarantee status; and
- Exchange eligibility.
Customers should read the entire product description and not rely only on the title, promotional image or appearance of the product.
A product benefit applies only where it is expressly stated on the relevant product page or legal invoice.
3. PRODUCT PHOTOGRAPHS AND COLOURS
We make reasonable efforts to display products accurately. However, the actual colour, shine or appearance may vary slightly because of:
- Studio or natural lighting;
- Camera settings;
- Image editing;
- Screen brightness;
- Mobile or computer display settings;
- Reflections from plated surfaces;
- Background colours;
- Image compression; and
- Individual visual perception.
A minor colour or appearance variation that does not materially change the product will not ordinarily be treated as a defect.
Product-only photographs, written specifications and measurements should be reviewed when assessing the product being offered.
4. MODEL, LIFESTYLE AND ILLUSTRATIVE IMAGES
Model and lifestyle images may be used to demonstrate how jewellery may look when worn or styled.
Such images may not show the exact scale because:
- Face, neck, wrist, ear, hand and body proportions vary;
- Camera angles may affect perceived dimensions;
- Styling may alter how the product falls or sits; and
- Products may be enlarged in an image to make design details visible.
Other clothing, jewellery, props, boxes and accessories shown in lifestyle images are not included unless expressly identified as part of the product.
5. ARTIFICIAL-INTELLIGENCE AND DIGITALLY ENHANCED IMAGES
Some promotional, model or lifestyle images may be digitally created, enhanced or generated using artificial-intelligence tools.
These images are intended for presentation and styling purposes and should not be treated as an exact representation of:
- The model;
- Background or setting;
- Product scale;
- Colour under every lighting condition; or
- Surrounding clothing and accessories.
We endeavour not to materially misrepresent the jewellery design.
Where there is a meaningful difference between an illustrative image and the product-only photograph or written specifications, the product-only photograph and written specifications should be used to understand the product being sold.
Nothing in this clause permits us to materially misdescribe a product.
6. DIMENSIONS, WEIGHT AND SCALE
Measurements such as length, width, diameter and weight may be approximate unless expressly stated as exact.
Minor variations may occur because of:
- Manual measurement;
- Manufacturing tolerances;
- Handmade production;
- Stone or bead placement;
- Decorative components; and
- Differences between production batches.
Customers should check written measurements and available size information before ordering.
A ruler, hand, neck, ear, model or display stand shown in an image may provide visual context but should not replace the stated measurements.
7. HANDMADE AND BATCH VARIATIONS
Some jewellery may include handmade, hand-finished or manually assembled components.
Minor variations may naturally occur in:
- Stone placement;
- Bead shape;
- Pearl shape;
- Surface texture;
- Polish;
- Colour tone;
- Pattern alignment;
- Decorative detailing; and
- Finishing.
These minor variations may form part of the product’s individual character and will not necessarily constitute a manufacturing defect.
A substantial difference affecting the product’s identity, functionality or material appearance may be reviewed under the Return, Exchange and Refund Policy.
8. STONES, BEADS AND DECORATIVE ELEMENTS
Unless expressly stated otherwise, stones, pearls, beads and coloured elements used in our jewellery may be artificial, simulated or decorative.
Differences in shade, surface, transparency, size or reflection may occur.
Decorative stones, beads and components may loosen or become detached because of:
- Impact;
- Bending;
- Pulling;
- Moisture;
- Chemicals;
- Improper handling;
- Inappropriate storage; or
- Ordinary wear.
Customers should inspect the product promptly after delivery and report an eligible manufacturing or stone-setting defect within the applicable policy period.
9. GOLD PLATING AND COLOUR LONGEVITY
Gold plating and other artificial finishes naturally experience wear over time.
The life of the colour, polish or plating depends on:
- Frequency of use;
- Skin chemistry;
- Sweat;
- Moisture and humidity;
- Exposure to perfume or deodorant;
- Cosmetics and skincare products;
- Soap and sanitizer;
- Household or industrial chemicals;
- Friction;
- Climate;
- Storage conditions; and
- Product-care practices.
No plated jewellery should be considered permanently resistant to all fading, tarnishing, scratching or colour change.
Any colour guarantee applies only where the product page or legal invoice expressly states that the product is “Guaranteed” and remains subject to the published guarantee conditions.
10. PRODUCT CARE
To help maintain the product’s appearance:
- Keep jewellery away from water and moisture;
- Remove jewellery before bathing or swimming;
- Remove it before exercising or sleeping;
- Avoid direct contact with sweat;
- Avoid perfume, deodorant, lotion and cosmetics;
- Avoid soap, sanitizer and chemicals;
- Wear jewellery after applying makeup and perfume;
- Do not pull, twist, bend or drop the product;
- Wipe it gently with a clean, soft and dry cloth after use;
- Store each product separately in a dry pouch or box;
- Avoid prolonged exposure to sunlight and humidity; and
- Keep jewellery away from children and pets.
Improper use or failure to follow reasonable care instructions may cause fading, tarnishing, scratching, breakage or loose stones and may affect guarantee eligibility.
11. SKIN SENSITIVITY AND ALLERGIES
Individual skin sensitivity differs. Artificial or plated jewellery may cause irritation or an allergic reaction in some individuals.
Customers with sensitive skin, known metal allergies or dermatological conditions should:
- Review the available material information;
- Avoid prolonged use where sensitivity is known;
- Test cautiously where appropriate; and
- Consult a qualified healthcare professional if necessary.
Stop wearing the product if redness, itching, swelling, pain or irritation occurs.
We do not represent that every product is nickel-free, allergy-free or hypoallergenic unless the individual product listing expressly states so.
12. EARRINGS AND HYGIENE
Earrings and other pierced or hygiene-sensitive jewellery are generally non-returnable after delivery.
An eligible remedy may still be considered where the product is:
- Damaged on delivery;
- Defective;
- Materially different from its listing; or
- Incorrectly supplied.
The customer should not wear or use the product after discovering the issue.
Any claim must comply with the applicable reporting period, evidence requirements and mandatory consumer rights.
13. SIZE AND FIT
Customers are responsible for reviewing product measurements and selecting the appropriate size before ordering.
Fit may vary depending on:
- Individual body proportions;
- Styling preference;
- Product design;
- Manufacturing tolerance; and
- How the product is worn.
Where a customer selects an incorrect size, an exchange may be considered only for an eligible, unused and unworn product with the original tag and packaging preserved.
The customer will bear applicable return and re-delivery charges for an incorrectly selected size.
If we supply a size different from the confirmed order, we will bear reasonable return and replacement shipping costs.
14. CUSTOMIZED OR PERSONALIZED PRODUCTS
Customized or personalized products may include jewellery that is:
- Engraved;
- Resized;
- Altered;
- Assembled to customer instructions;
- Produced in a selected colour or design;
- Made with customer-provided names or initials; or
- Specially sourced for a customer.
Customers must carefully verify all customization instructions before approval, including:
- Names and spelling;
- Initials;
- Dates;
- Measurements;
- Size;
- Colour;
- Design;
- Quantity; and
- Placement.
Minor differences arising naturally from handmade or customized production may occur.
Customized products are ordinarily non-cancellable once work begins and non-returnable after delivery.
An appropriate remedy may still be available if the product is damaged, defective, incorrectly supplied or materially different from the confirmed customization instructions.
15. SEVEN-DAY GUARANTEE
A seven-day guarantee applies only to products whose product page or legal invoice expressly states “Guaranteed.”
The guarantee period begins on the date of delivery.
Subject to inspection, the guarantee may cover:
- Colour or plating defects arising during the guarantee period;
- Manufacturing defects;
- Stone-setting defects; and
- Breakage directly caused by a manufacturing defect.
The guarantee does not cover:
- Normal wear and tear;
- Fading resulting from ordinary or improper use;
- Accidental or customer-caused breakage;
- Scratches, bending, pulling or impact damage;
- Exposure to water, sweat, perfume or chemicals;
- Improper storage;
- Missing components resulting from use;
- Unauthorized repair, alteration or modification;
- Damage caused by another person; or
- Failure to follow care instructions.
A guarantee claim requires:
- Product;
- Original legal invoice or readable copy;
- Supporting photographs or video; and
- A description of the issue.
Approval and the appropriate remedy are subject to inspection and verification.
Depending on the verified defect, we may offer repair, replacement, exchange, refund or another appropriate remedy.
16. LIFETIME 50% EXCHANGE DISCLAIMER
The Lifetime 50% Exchange Programme is a commercial exchange benefit. It is not:
- A product warranty;
- A cash buyback guarantee;
- An investment scheme;
- A promise of appreciation in value;
- A precious-metal valuation; or
- A guaranteed resale market.
The programme applies only where the product page or legal invoice expressly states “Lifetime 50% Exchange” or otherwise marks the product as eligible.
Subject to the detailed programme policy:
- The original invoice or a readable photograph or digital copy is compulsory;
- The old product must be physically returned and inspected;
- The customer must purchase another product from the same category;
- The exchange value is 50% of the original taxable product value after excluding the GST component shown on the invoice;
- Shipping, COD and service charges are excluded;
- No cash refund will be provided;
- No unused balance will be paid in cash;
- The customer must pay any price difference;
- The customer must bear transportation and delivery charges; and
- Product identity, authenticity, completeness and condition must be verified.
Missing principal parts, deliberate damage, severe breakage, substitution, alteration or tampering may reduce or cancel the exchange benefit.
“Lifetime” means for as long as Bombay Jewellery and Cosmetics continues to operate the programme under its published terms and applicable law.
17. RETURNS AND REPORTING PERIOD
An eligible claim involving a damaged, defective, missing, materially different or incorrect product should ordinarily be submitted within 48 hours after delivery.
Customers should preserve:
- Product;
- Original tag;
- Invoice or readable copy;
- Outer package;
- Shipping label;
- Product packaging;
- Accessories and components; and
- Parcel-opening video, where available.
Change-of-mind or dislike returns are not accepted.
Sale, discounted and clearance products are generally non-returnable except where they are damaged, defective, materially misdescribed or incorrectly supplied.
Complete eligibility requirements are stated in the Return, Exchange and Refund Policy.
18. UNBOXING VIDEO
Customers should record a clear and continuous parcel-opening video beginning before the outer package is opened.
The video should show:
- Sealed parcel;
- Shipping label;
- Complete opening process;
- All products and components received; and
- Reported damage, missing item or incorrect product.
An unboxing video is the preferred primary evidence for damaged, missing or incorrect-product claims.
However, each claim will be assessed using its facts, available credible evidence and mandatory consumer rights.
19. PACKAGING
Product packaging shown in photographs may be illustrative.
The supplied box, pouch, card, display stand or other packaging may vary because of:
- Product type;
- Availability;
- Shipping requirements;
- Supplier changes; and
- Promotional campaigns.
A packaging difference does not constitute a product defect unless a particular packaging item was expressly included as part of the purchased product.
20. PRODUCT AVAILABILITY AND DESIGN UPDATES
Product availability is subject to stock.
We may discontinue a product or update its packaging, presentation or non-material specifications.
We will not knowingly substitute a materially different product without the customer’s agreement.
If an ordered product is unavailable, we may offer an alternative or cancel the affected product and issue the applicable refund. The customer is not required to accept an alternative.
21. PRICING AND PROMOTIONAL LANGUAGE
Prices and promotional offers may change.
The price displayed at checkout when an order is placed will apply to the accepted order, subject to correction of an obvious technical or pricing error.
Terms such as “premium,” “royal,” “high-class,” “traditional,” “festive,” “luxury look” or similar wording describe style and brand presentation.
Such terms do not by themselves represent:
- Precious-metal content;
- Investment value;
- Certification;
- Permanent plating; or
- A particular gemstone composition.
22. PRODUCT USE AND SAFETY
Jewellery should be used only for its ordinary decorative purpose.
Customers should:
- Keep small parts away from young children and pets;
- Avoid wearing jewellery where it may become caught in machinery or equipment;
- Avoid sleeping, bathing, swimming or exercising while wearing delicate jewellery;
- Avoid forcefully bending adjustable products;
- Use appropriate supervision where jewellery is worn by a minor; and
- Stop using a damaged product with sharp or exposed components.
Our jewellery is not intended as a medical, protective or safety device.
23. CUSTOMER INSPECTION AFTER DELIVERY
Customers should inspect the order promptly after delivery.
If a product appears damaged, incorrect, incomplete or materially different from its description, the customer should:
- Stop using the product;
- Preserve all packaging and tags;
- Record the issue clearly;
- Retain the invoice; and
- Contact us within the applicable reporting period.
Using, wearing, repairing, cleaning or altering the product after discovering an issue may affect the ability to verify the claim.
24. LIMITATION OF THIS DISCLAIMER
Nothing in this Product Disclaimer excludes, restricts or replaces a consumer right or remedy that cannot legally be excluded under Indian law.
This Disclaimer does not remove our responsibility for a product that is:
- Defective;
- Falsely described;
- Materially different from its listing;
- Incorrectly supplied; or
- Supplied in violation of applicable law.
Where this Disclaimer conflicts with a mandatory legal requirement, the mandatory legal requirement will prevail.
25. CHANGES TO THIS DISCLAIMER
We may update this Product Disclaimer to reflect product, operational, legal or regulatory changes.
The updated version will be published on the website with a revised effective date.
Changes will apply prospectively and will not unfairly remove rights already accrued in relation to an accepted order.
